2. Nature of our website

2.1 Our website is a place for you to select and order bespoke works of art (‘the products’). Our products range from forward thinking works of Art, to Sculptures, Music and furniture from around the world by various Artists & Designers, commissioned by Symplest. Our website describes the Products in more detail.

2.2 Please note that our website is available only to individuals that can form legally binding contracts under applicable law. You must therefore be over 18 years to purchase the Products, using the payment methods displayed on our website. If you do not qualify, please leave our website now.

3. Buying products on our website

3.1 To order a product you will need to follow the ordering procedures set out on our order page. Details of our prices for the Products, and the procedures for payment and delivery are displayed on our website.

3.2 Most of our products are made to order, ie they are bespoke. We therefore require payment of 50% of the order value to process the order. In addition after we have confirmed the order details with you, we will need cleared funds to start processing your order. Approximately one week prior to delivery of the goods, you will be required to settle the remainder of the order amount. You will be contacted when final payment becomes due. Please ensure payment clears prior to delivery to avoid any delays. We are able to accommodate special requirements. If you would like to specify anything unique (non-standard dimensions) or have any other special request, please call us on the number on our website. To the fullest extent permitted by law the Consumer Protection (Distance Selling) Regulations 2000 is excluded.

3.3 You can pay for any of our products on the Site by using the following methods:

2. Telephone: You can call us with your order on 01483 45 25 25. We are open five days a week, 09:00am to 05:00pm.
3. By eMail. You must provide as many details of your requirements as possible. Please DO NOT send any payment or account details via email.

In all cases the price of any Product is the price in force at the date and time of your order. We may change the price of any Product before you place an order. We try to ensure that our prices displayed on our website are accurate but the price on your order will need to be validated by us as part of the acceptance procedure (see clause 3.4 below). We will inform you if a Product’s correct price is higher than that stated in your order and you may cancel the order and decide whether or not to order the product at the correct price. The prices are exclusive of delivery costs and applicable taxes, for example VAT.

3.4 Symplest is entitled to refuse any order placed by you. If your order is accepted, we will confirm acceptance to you by online electronic means (‘Confirmation’) to the e-mail address you have given us on registration or on ordering. The order will then be fulfilled by the date set out in the Confirmation or, if the Confirmation does not contain such a date, within 30 days.

3.5 You undertake that all details you provide to us for the purpose of purchasing goods or services which may be offered by us on our website will be correct, that the credit or debit card, which you use is your own and that there are sufficient funds or credit facilities to cover the cost the Products. We reserve the right to obtain validation of your credit or debit card details or verification of the authenticity and ownership of the card before providing you with any goods or services.

4. Returns

4.1 We really do hope you like what you ordered. However you may return any Products you have purchased within 7 working days of delivery for any reason (including if you simply change your mind). To do so you must notify us in writing or other durable medium (including e-mail) within those 7 working days. You will then be entitled to a refund from which will be paid as soon as possible, but in any event within 30 days. You must arrange for and pay the costs of returning the Products to us. While in your possession, you must keep any Products you intend to return to us in good condition.

4.2 If:

1. The Product delivered is not what you ordered, or does not correspond with its description;
2. The Product delivered is not of a satisfactory quality; or
3. The Product is not fit for any other purpose for which you have bought it and you notified us of this purpose before purchase, and have not informed you that the Product is not fit for that purpose;

We will, at its option, deliver to you a replacement Product or refund to you the price paid and your reasonable costs of returning the Products.

8. Delivery of the Products

8.1 We cannot give you a standard delivery charge, due to the nature of the products that we sell, (they come in all shapes, sizes and weights). We work with shipment companies to get the least cost route for you. Delivery from within mainland UK to mainland UK is typically free on orders over £500. Delivery to remote locations within the UK will incur additional charges. Special delivery requirements such as weekend or evening delivery or difficult access will incur additional charges. The products will only be shipped after your balance has been cleared. In most cases you will be contacted by our delivery company to arrange a delivery date and time. Please make sure you are available to receive the goods as a charge will be required for re-deliveries. Please also note that you are responsible for ensuring the goods can actually be delivered where you requested. If access is not possible re-delivery charges will apply, as well as any other charges for any special services.

9. Security

When you register with us you are solely responsible in all respects for all use of and for protecting the confidentiality of any username, e-mail verification and password that may be given to you or selected by you for use on our website.
